These terms are in effect for the public beta. A licensed attorney has not yet completed a review. We may update this page after counsel markup. Questions: contact us.

You are using the CutTheShift app because your employer or restaurant invited you. Your restaurant controls schedules, timeclock rules, and your employment relationship. Cut the Shift LLC provides software tools to your restaurant.

Employment relationship

These worker terms govern your use of the apps and website. They do not replace your employment agreement, handbook, or wage practices. Pay, tips, and scheduling disputes are between you and your restaurant.

Age

You must be authorized by your restaurant to use the Service. The Service is not directed to children under 13. If you are 14–17, you may use the Service only as allowed by your restaurant and applicable law. Your restaurant is responsible for child-labor compliance.

Location at clock-in

If your restaurant enables geofenced timeclock features, the app may collect precise location at punch time (for example coordinates, accuracy, and whether you are inside the workplace geofence). Optional features may include venue Wi-Fi or beacon checks and arrive-near-work reminders using system location permissions (including an optional Always authorization for region monitoring). CutTheShift does not provide continuous background tracking or a live staff location map as a product feature. Your restaurant is responsible for workplace notices required by law. You can deny system location permissions; some clock-in features may then be unavailable.

Tips and payouts

Tip and payout features, if enabled, follow your restaurant's policies and any third-party payment partner terms. Instant options, when live, may include a disclosed fee. CutTheShift is not your employer and is not a bank. Traditional wage payroll remains your restaurant's responsibility. Zelle and in-app pay-for-shift features are not part of the product.

Acceptable use

Use the Service only for legitimate work purposes authorized by your restaurant. Do not falsify time punches or location data, or try to bypass security or geofence controls.

Privacy

How personal data is handled is described in our Privacy Policy. For workplace data processed for your restaurant, your restaurant is typically the controller and CutTheShift is the processor. Privacy requests: contact form.

Disclaimer

The app is provided "as is." To the maximum extent permitted by law, CutTheShift's liability to you for app use is limited to $0 (you do not pay us directly for the app during the public beta). This does not limit rights you may have against your restaurant under employment law.
